Djukic case/update 3 : Prosecutor files motion to withdraw Djukic's indictment.

 

The Prosecutor of the International Tribunal for the Former Yugoslavia has requested that the indictment against General Dorde DJUKIC be withdrawn on the grounds of his "rapidly deteriorating" health.

THIS MATTER WILL BE CONSIDERED BY TRIAL CHAMBER I ON 22 APRIL 1996 AT 4.30 P.M.

In a motion filed on 19 April 1996, under Rule 51 (A) of the Rules of Procedure and Evidence, the Prosecutor asked the Tribunal to withdraw the indictment, without prejudice to the Prosecutor's right to re-indict the General at some time in the future should the circumstances of the accused's medical condition change.

The Prosecutor argues that, based on the independent medical examination performed on General Djukic, the defendant is suffering from a terminal disease, and that it would thus be "unjust and inhumane" to force him to stand trial. The Prosecutor believes that "the progressive nature of his medical condition is such that he would very soon be unable to meaningfully participate in his defence. A trial under such conditions would be inherently unfair".

As this matter is to be considered by the judges, no further details and comments will be provided.
