Radovan Stankovic to be Transferred to Bosnia and Herzegovina to Stand Trial Following Appeals Chamber Decision

 

On 1 September 2005, the Appeals Chamber of the ICTY dismissed Radovan Stanković’s appeal against the Decision by the Tribunal’s Referral Bench to transfer his case to Bosnia and Herzegovina, pursuant to Rule 11bis of the Rules of Procedure and Evidence.

In its Decision, the Appeals Chamber also allowed the appeal of the Prosecution in part insofar as it, “objects to the Referral Bench’s order instructing the Prosecutor to continue her efforts to conclude an agreement with an international organization for monitoring purposes and to seek further direction from the Referral Bench if an agreement is not concluded”.

Pursuant to the Referral Bench’s 17 May 2005 Decision, the Registrar now has to transfer the accused and the Prosecution has to hand over the material supporting the indictment and all other appropriate evidence to the relevant authorities in Bosnia and Herzegovina, within 30 days.
