This Bench of the Appeals Chamber ("Appeals Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal");

NOTING Anto Nobilo’s Application for Leave to Appeal Decision of Trial Chamber I dated 11 December 1998 Regarding Finding of Contempt of the Tribunal, filed on 18 December 1998 ("Appeal");

NOTING the Decision on Application of Mr. Nobilo for Leave to Appeal the Trial Chamber finding of Contempt, by a Bench of three Judges of the Appeals Chamber, filed 22 December 1998;

CONSIDERING Anto Nobilo’s Application for Briefing Schedule re Appeal of Decision of Trial Chamber I dated 11 December 1998 Regarding Finding of Contempt of the Tribunal, filed on 14 January 1999;

HEREBY REQUESTS the Office of the Prosecutor ("Prosecution") to participate in the proceedings in this matter;

PURSUANT TO Rule 94ter and Rule 116bis of the Rules of Procedure and Evidence of the International Tribunal;

ORDERS the:

1. Appellant to file his written submissions by 12 February 1999;

2. Appellant to file an affidavit containing any evidence in relation to which he will seek leave to tender by 12 February 1999;

3. Prosecution to file its Response to the Appellant’s written submissions by 19 February 1999;

4. Appellant to file his Reply to the Prosecution’s Response by 26 February 1999;

AND INFORMS the parties that oral arguments on the merits of the Appeal shall be held at a date to be fixed.
