THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),
HAVING ACCEPTED a guilty plea to Count 1 of the Consolidated Indictment from the accused, Predrag Banovic, on 26 June 2003, pursuant to a “Joint Motion for the Consideration of a Plea Agreement between Predrag Banović and the Office of the Prosecutor” filed on 18 June 2003 (“Motion”),
NOTING that the Plea Agreement between the parties dated 5 June 2003 ("Plea Agreement") attached to the Motion has been filed on a confidential basis,
CONSIDERING that Rule 62 ter of the Rules of Procedure and Evidence of the International Tribunal ("Rules") requires the disclosure of the Plea Agreement in open session at the time the accused pleads guilty unless the parties can show good cause why the agreement should only be disclosed in closed session,
PURSUANT to Rules 54 and Rule 62 ter of the Rules
HEREBY DIRECTS the Registry of the International Tribunal to release the Plea Agreement as a public document seven days after the issue of this Order unless, within that time, either of the parties files a motion showing good cause why the confidential nature of the filing should be maintained.
