I, Fausto Pocar, Pre-Appeal Judge in this appeal,

BEING SEISED of the "Appellant’s Application for Extension of Page Limits re Fourth Motion to Admit Additional Evidence on Appeal pursuant to Rule 115" ("Appellant’s Application") filed on 5 May 2003, in which the Appellant applies to the Appeals Chamber for leave to file his fourth motion to admit additional evidence pursuant to Rule 115 of the Rules of Procedure and Evidence of the International Tribunal ("Fourth Motion") up to a maximum of 50 pages in length, thus exceeding the limit of 10 pages or 3,000 words--whichever is greater, set in Section (C), paragraph 7, of the Practice Direction on the Length of Briefs and Motions (IT/184 Rev.1, 5 March 2002);

NOTING the "Prosecution’s Response to the Appellant’s Application for Extension of Page Limits re Fourth Motion to Admit Additional Evidence on Appeal pursuant to Rule 115", filed on 7 May 2003, in which no objection is expressed in respect of the extension of page limits sought in the Appellant’s Application;

CONSIDERING that the Appellant’s Application reveals that the Fourth Motion will contain "a complete and proper analysis" of "approximately" 60 documents sought to be admitted as additional evidence;

CONSIDERING that the Appellant’s Application has shown that an extension of the page limit for the Fourth Motion is indeed necessary;

PURSUANT to Section (C), paragraph 7, of the Practice Direction on the Length of Briefs and Motions (IT/184 Rev.1, 5 March 2002),

HEREBY GRANT the Appellant’s Application, EXTEND the page limit for the Fourth Motion up to 50 pages, and REMIND the Appellant, when preparing the Fourth Motion, to comply with the format and typeface set out in Sections (A) and (B) of the Practice Direction on the Length of Briefs and Motions (IT/184 Rev.1, 5 March 2002).

Done in both English and French, the English text being authoritative.
