I, O-GON KWON, Judge of Trial Chamber III of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal"),

HAVING BEEN DESIGNATED, pursuant to Article 14 of the Statute of the International Tribunal and Rules 54 and 77 of its Rules of Procedure and Evidence ("Rules"), as the Presiding Judge in the case of Prosecutor v. Ivica Marijacic and Markica Rebic, with the power to exercise all powers of a pre-trial Judge in this matter, by an Order dated 27 May 2005,

NOTING the "Decision on Motions to Dismiss the Indictment and Order on Motions to Amend the Indictment," issued by the Trial Chamber on 6 September 2005,

CONSIDERING the “Defendant Ivica Marijacic’s Request for Extension of Time to Respond to the Trial Chamber’s Order of 6 September 2005,” filed on 15 September ("Motion"), which states that the Accused Ivica Marijacic has not received a copy of the Confidential "Prosecution’s Response to the Decision on Motions to Dismiss the Indictment and Order on Motions to Amend the Indictment," filed on 9 September 2005 ("Prosecution’s Response"),

PURSUANT TO Rule 54,

HEREBY GRANT the Motion and ORDER AS FOLLOWS:

  1. The Registrar shall ensure that Ivica Marijacic and Markica Rebic both receive copies of the Prosecution’s Response, by 16 September 2005;

  2. Ivica Marijacic and Markica Rebic shall file any remaining responses to the Prosecution’s “Motion for Leave to Amend the Indictment,” filed on 23 June 2005, and "Second Motion for Leave to Amend Indictment," filed by the Prosecution on 29 August 2005, including any arguments based on the clarifications provided in the Prosecution’s Response, by 23 September 2005.
