TO: The responsible authorities of the Republic of Croatia

I, Carmel Agius, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal"):

CONSIDERING United Nations Security Council Resolution 827 of 25 May 1993, Article 21, para. 4 (a) and Article 29 of the Statute of the Tribunal, Rule 53bis and Rule 54 of the Rules of Procedure and Evidence;

CONSIDERING the indictment against Janko Bobetko ("Accused"), retired Corps General of the Croatian army, born on 10 January 1919 in the Sisak region of the Republic of Croatia, dated 12 September 2002 and confirmed by Judge Liu on 17 September 2002, a copy of which is annexed to this order;

HEREBY DIRECT the authorities of the Republic of Croatia to:

1. serve the indictment upon either the Accused himself or counsel of his own choice, in a language the Accused understands;
2. confirm the service of the indictment within 15 days of the issuance of this Decision;
3. inform the Accused or counsel of his own choice of the suspension of the warrants of arrest and orders for surrender, issued by this Tribunal on 17 and 20 September 2002, which suspension is being ordered to be effective immediately upon the service of the said indictment upon the Accused or counsel of his own choice;
4. provide an updated medical report on a monthly basis on the state of health of the Accused and submit such a report to the Registrar of this Tribunal.

AND AUTHORISE the Registrar of this Tribunal to deliver this Order to the Government of the Republic of Croatia.
