I, Carmel Agius, Presiding Judge of Trial Chamber II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal");

NOTING the Indictment in the case The Prosecutor v. Ljubomir Borovcanin confirmed by Judge Wolfgang Schomburg on 6 September 2002;

NOTING the "Order to Lift the Seal of the Seal of Confidentiality of the Indictment, Arrest Warrant and Non-disclosure Warrant" by Judge Wolfgang Schomburg dated 29 September 2002 lifting the confidentiality of the Indictment against Ljubomir Borovcanin ("Accused");

NOTING that Ljubomir Borovcanin ("Accused") surrendered and was transferred to the seat of the Tribunal on 1 April 2005;

NOTING the Order by the President of the Tribunal dated 31 March 2005 assigning the case against Ljubomir Borovcanin to Trial Chamber II;

CONSIDERING Rule 65ter(A) of the Rules providing that the Presiding Judge of the Trial Chamber shall "designate from among its members a Judge responsible for the pre-trial proceedings" ("pre-trial Judge");

NOTING the powers of a pre-trial Judge as set out in Rule 65ter of the Rules;

PURSUANT TO Rule 65ter (A) of the Rules;

DESIGNATE Judge Jean Claude Antonetti as pre-trial Judge for this case.
