ORDER TO LIFT THE SEAL OF CONFIDENTIALITY OF THE INDICTMENT, ARREST WARRANT AND NON-DISCLOSURE WARRANT

I, Judge Wolfgang Schomburg, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal");

BEING SEISED OF the "Motion of the Prosecutor to Vacate in Part the Order for Non-Disclosure Entered 6 September 2002 ("Motion");

NOTING that an Order, dated 6 September 2002, was issued by the Tribunal which prohibited the disclosure of the Indictment, the supporting materials, and arrest warrants until arrest of the Accused Ljubomir Borovcanin or until further order by the Tribunal ("Order");

CONSIDERING that the Motion argues that circumstances surrounding the arrest of the Accused have changed such that the non-disclosure of the Indictment is no longer justified;

PURSUANT TO Rules 53 and 54 of the Rules of Procedure and Evidence;

HEREBY ORDER THAT:

  1. The Order of 6 September 2002 is hereby vacated to the end that the order to keep the indictment and arrest warrants under seal is no longer applicable.
  2. Public disclosure of this Order, the Indictment and arrest warrants in this case shall be permitted.
  3. The supporting materials shall remain under seal until further order.
