DECISION ON MOTION BY AMICUS CURIAE PROSECUTOR FOR EXTENSION OF TIME TO DISCLOSE RECORD OF INTERVIEW OF RESPONDENT

_____________________________

Amicus Curiae Prosecutor:

Ms. Brenda Hollis

The Respondent:

Ms. Milka Maglov

TRIAL CHAMBER II ("Trial Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal"):

BEING SEISED OF the "Motion by Amicus Curiae Prosecutor for Extension of Time to Disclose Record of Interview of Respondent" ("Motion") filed on 15 January 2004, in which the amicus curiae Prosecutor requests the Trial Chamber for an extension of time until 27 January 2004 to disclose to Milka Maglov ("Respondent") a statement of the Respondent of 6 June 2002, which is based on an interview conducted by the amicus curiae Investigator on 23 May 2002 ("Interview");

NOTING that during the Status Conference held on 4 December 2003, the Trial Chamber ordered the Prosecutor to complete disclosure to the Respondent no later than 19 January 2004;

CONSIDERING that in its Motion, the amicus curiae Prosecutor has given good reasons for not being able to comply with the deadline referred to above in relation to the Interview;

NOTING that Registry/OLAD has indicated to the Trial Chamber that, for technical reasons, it will not be in a position to make available to the amicus curiae Prosecutor a verbatim transcription as well as a translation of the Interview before 30 January 2004;

CONSIDERING that by extending the time for the amicus curiae Prosecutor to disclose the Interview to the Respondent from 19 January 2004 to 30 January 2004, the Respondent is not unfairly prejudiced;

FOR THE FOREGOING REASONS

PURSUANT TO Rules 54 of the Tribunals Rules of Procedure and Evidence;

HEREBY:

grants the Motion and orders that the amicus curiae Prosecutor disclose the Interview to the Respondent no later than 30 January 2004.

Done in French and English, the English version being authoritative.

Dated this 26th day of January 2004.
