2 [Open session]

3 --- Upon commencing at 9.08 a.m.

4 [The accused entered court]

5 JUDGE AGIUS: Madam Registrar, could you call the case, please.

6 THE REGISTRAR: Yes, Your Honour. Good morning, Your Honours.

7 This is case number IT-99-36-T, the Prosecutor versus Radoslav Brdjanin.

8 JUDGE AGIUS: Thank you. Mr. Brdjanin, can you hear me in a

9 language that you can understand?

10 THE ACCUSED: [Interpretation] Good morning, Your Honour. Yes, I

11 can hear you and understand you.

12 JUDGE AGIUS: Thank you. You may sit down. Appearances for the

13 Prosecution?

14 MS. KORNER: Good morning, Your Honours. Joanna Korner assisted

15 by Denise Gustin, case manager.

16 JUDGE AGIUS: Thank you. Good morning to you. Appearances for

17 Radoslav Brdjanin?

18 MR. ACKERMAN: Good morning Your Honours, I'm John Ackerman with

19 David Cunningham and Vesna Anic.

20 JUDGE AGIUS: I thank you and good morning to you. I was told and

21 I can feel it actually, that the temperature inside the courtroom is not

22 exactly as it should be. If it becomes an inconvenience, let -- yes,

23 Ms. Korner?

24 MS. KORNER: [Microphone not activated] I was just standing

25 because I thought Your Honour was addressing me.

1 THE INTERPRETER: Microphone, please.

2 JUDGE AGIUS: If it becomes an inconvenience, do let me know and I

3 have already seen arrangements could be made then to shift to Courtroom

4 II, where presumably it will be a little bit cooler but it seems that the

5 problem that there was with the air-conditioning is solved because I can

6 feel the cool air coming in but if it becomes either too cold or too warm,

7 let me know. Thank you.

8 MS. KORNER: While I'm on my feet, may I take the opportunity just

9 to ask Your Honours again I know that we are pestering slightly about

10 this, when we can expect the decision.

11 JUDGE AGIUS: This week.

12 MS. KORNER: Yes. I say Your Honour said that last week.

13 JUDGE AGIUS: Exactly. Last week I said it will be next week,

14 which is this week. So now, any other preliminaries before we bring in

15 the witness? We are in closed session now, all right? We go into closed

16 session. And Madam Usher can bring in the witness, please.
