TRIAL CHAMBER I ("the Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal");

NOTING the Decision of Judge Carmel Agius to confirm the indictment against Beqë BEQAJ ("the Accused") and the Warrants of Arrest and Orders for Surrender, all issued ex parte and under seal on 29th October 2004;

NOTING the President’s confidential Order of 3rd November 2004 to assign the case to Trial Chamber I as of the date of transfer of the Accused to the seat of the Tribunal;

NOTING the arrest in Pristina by UNMIK on 19th October 2004 of the then suspect and his subsequent transfer to the custody of the Tribunal on 4th November 2004;

NOTING the Chamber’s Decision of 4th November 2004 to vacate the Order for non-disclosure of the indictment;

NOTING that, during the initial appearance, leave was granted to amend the indictment, in order that the first name of the Accused be corrected and spelled as follows: Beqa;

NOTING that, during the initial appearance, the defence counsel did not make any submissions challenging pre-trial detention but indicated that he would address the matter at a latter stage;

PURSUANT to Rule 64 of the Tribunal’s Rules of Procedure and Evidence;

HEREBY ORDERS the detention on remand of Beqa BEQAJ and enjoins the Commanding Officer of the United Nations Detention Unit in The Hague to detain the Accused until further Order.
