THIS TRIAL CHAMBER, seized of the "Joint Application for Clarification and/or Extension of Time-limit for Filing Complaints Against Amended Indictment in Briefs not Exceeding Thirty Pages in Total", filed by the Defence on 22 January 2002 ("Motion");

NOTING that the Defence requests that the fourteen-day time-limit for the filing of complaints against the amended indictment in this case be counted from the date on which the Defence is provided with a copy of the amended indictment in the language of the accused;

CONSIDERING that in the specific circumstances this request should be granted in the light of the importance of the amended indictment, and in particular, in the light of the importance of according to the accused an opportunity to properly instruct counsel on the amended indictment;

NOTING FURTHER that the Defence requests permission to file both joint and individual complaints against the amended indictment in submissions not exceeding thirty pages in total;

CONSIDERING that in the specific circumstances this request should be granted in the light of the importance of the issues surrounding the amended indictment;

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence hereby

  1. Grants leave to the Defence to file the complaints resulting from the amendments made to the indictment within fourteen days from the date on which the Defence is provided with a copy of the amended indictment in the language of the accused.
  2. Grants leave to the Defence to file both joint and individual complaints against the amended indictment in submissions not exceeding thirty pages in total.
