THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING that during the Pre-Trial Conference held on 15 July 2003 pursuant to Rule 73bis of the Rules of Procedure and Evidence of the International Tribunal ("Rules"), the Trial Chamber stated the trial should commence in January 2004,1

NOTING that during the status conference held on 1 October 2003 pursuant to Rule 65bis of the Rules, the pre-trial Judge heard from both parties regarding the possible commencement of trial in mid November 2003,

NOTING that the Office of the Prosecutor ("Prosecution") stated that it would be ready to commence trial by November 2003, but the Defence stated that it would not because it had expected to commence trial in January 2004 and had planned its work accordingly,2

NOTING that the pre-trial Judge granted the Defence leave to file a further written submission on the matter and that the Defence consequently filed the "Defence Submission In Relation To The Starting Date For Trial" on 8 October 2003,

CONSIDERING all the aspects pertaining to this case,

PURSUANT TO Rule 54 of the Rules,

HEREBY ORDERS that the trial will commence on 19 January 2004.
