I, Judge Hunt, Pre-Appeal Judge in this case,

NOTING "Mario Cerkez’s Motion to Admit Additional Evidence on Appeal Pursuant to Rule 115", filed on 7 April 2003 ("Cerkez’s Rule 115 Motion") and "Mario Cerkez’s Supplemental Application for Admittance of one Document as Additional Evidence on Appeal", filed on 9 April 2003 ("Supplemental Application");

NOTING the Scheduling Order of 22 April 2003 in which the Prosecution was ordered to file its Response to Cerkez’s Rule 115 Motion and Supplemental Application no later than 12 May 2003;

BEING SEISED OF a "Motion for Request of Page Limit to Respond to Mario Cerkez’s Motion to Admit Additional Evidence", filed on 7 May 2003, whereby the Prosecution seeks leave to exceed the page limit set by Practice Direction on the Length of Briefs and Motions ("Practice Direction") and to file a Response in the range of 110 pages;

NOTING that, pursuant to the Practice Direction, the Prosecution’s Response should in principle not exceed 10 pages or 3,000 words, whichever is the greater;

NOTING that the Cerkez’s Rule 115 Motion and Supplemental Application, including the evidence submitted pursuant to Rule 115, total more than 800 pages, whilst his submissions total nearly a hundred pages;

NOTING that Cerkez was himself granted an extension of pages in relation to his Rule 115 Motion;1

NOTING that Cerkez does not object to the extension of pages being granted;2

CONSIDERING that the amount of material and submissions involved and the number of matters to be addressed by the Prosecution in his Response justify such an extension of pages being granted;

CONSIDERING that good cause has been shown;

HEREBY GRANT the Prosecution’s Request to exceed the page limit provided for in the Practice Direction and ORDER the Prosecution to file a Response not exceeding 115 pages.
