I, Lal Chand Vohrah, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("the International Tribunal"), exercising the functions of the President pursuant to Rule 22 of the Rules of Procedure and Evidence of the International Tribunal ("the Rules"),
NOTING the "Application for Leave to Pursue an Interlocutory Appeal of the Trial Chambers 25 June 1999 Decision Stating Reasons for Trial Chambers Ruling of 1 June 1999 Rejecting Defense Motion to Suppress Evidence" filed on 2 July 1999 by Defence Counsel for Dario Kordic ("the Application for Leave to Appeal");
NOTING the "Order of the President for the Assignment of Judges to a Bench of the Appeals Chamber", issued on 26 July 1999;
CONSIDERING that President Gabrielle Kirk McDonald has withdrawn herself from hearing the Application for Leave to Appeal;
HAVING CONSULTED the Judges of the International Tribunal;
CONSIDERING Article 14(3) of the Statute of the International Tribunal and Rules 27 and 73 of the Rules;
PURSUANT to Rule 22 of the Rules;
HEREBY DECIDE to assign Judge Rafael Nieto-Navia to the bench of the Appeals Chamber provided for under Rule 73 of the Rules for the purpose of deciding upon the Application for Leave to Appeal;
AND THEREFORE, subject to sub-Rule 22(B) of the Rules, the Bench of the Appeals Chamber in case IT-95-14/2-AR73.4, the Prosecutor v. Dario Kordic and Mario Cerkez, shall be composed as follows:
