THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of the Request for Leave to File a Reply to Prosecutor’s Response to Defence Preliminary Motion on the Form of the Indictment ("Request"), filed on 29 January 1998,

NOTING the Defence Preliminary Motion on the Form of the Indictment, filed on 8 January 1999, and the Prosecutor’s Response to Defence Preliminary Motion on the Form of the Indictment ("Prosecutor’s Response"), filed on 22 January 1999,

RECALLING the Order for Filing of Motions, filed on 17 June 1998,

CONSIDERING the need to ensure a fair and expeditious trial,

HEREBY ORDERS as follows:

  1. the Defence is granted leave to file a response to the Prosecutor’s Response by Wednesday, 10 February 1999, with the proviso that the matters raised are solely by way of reply; and
  2. a Decision on the Defence request for oral argument on the form of the indictment is deferred.
