I, Lal Chand Vohrah, Judge of the International Tribunal for the Former Yugoslavia, in Chambers,

NOTING that I confirmed the indictment against the accused Dragan Gagovic, born on 13 June 1960, and seven other accused on 26 June 1996,

NOTING that the accused Dragan Gagovic has not initially appeared before a Trial Chamber pursuant to Rule 62 of the Rules of Procedure and Evidence ("the Rules"),

NOTING that the Office of the Prosecutor in its "Motion for Leave to Withdraw Indictment", filed on 26 July 1999, requests leave to withdraw the indictment against the accused Dragan Gagovic pursuant to Rule 51 on the ground that he died on 9 January 1999 in Gorazde, Bosnia and Herzegovina,

NOTING that in the attached copy of "Entry from Register of Deaths" in the municipality of Serbian Gorazde in Republika Sprska, dated 25 January, the death of Dragan Gagovic, born on 13 June 1960, is registered to have occurred on 9 January 1999 at about 1200 hours in Serbian Gorazde,

PURSUANT to Rule 51 of the Rules,

GRANT the Prosecutor leave to withdraw the indictment against Dragan Gagovic.
