I, MOHAMED BENNOUNA, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("the International Tribunal"),

HAVING BEEN APPOINTED as pre-appeal Judge in this matter by virtue of an order of the Appeals Chamber dated 16 May 2000;

BEING SEIZED OF the "Motion For Clarification of Order of Appeals’ [sic] Chamber Dated 29th September 2000", filed by the Defence for Vlatko Kupreskic on 9 October 2000;

NOTING the "Motion, Pursuant to Rule 115, for Admission of Additional Evidence on Appeal by the Appellant, Vlatko Kupreskic" filed confidentially by the Defense for Vlatko Kupreskic on 5 September 2000 ("the Vlatko Kupreskic’s Motion for Admission of Additional Evidence");

NOTING the "Order for Clarification" issued on 29 September 2000 ("the Order"), which ordered that "the Prosecution may respond to Vlatko Kupreskic’s Motion for Admission of Additional Evidence as well as any motion for additional evidence filed by Zoran Kupreskic, Mirjan Kupreskic, Drago Josipovic and Vladimir Santic on 4 October 2000 or before, ten days after the filing of all documents referred to in such motions in an official language of the International Tribunal";

NOTING the "Request of the Counsel of Drago Josipovic for the Derivation [sic] of Additional Proofs [sic] considering Rule 115 of the Book of Rules and Procedure [sic]" filed confidentially by the Defense for Drago Josipovic on 4 October 2000, the "Request for the Derivation [sic] of Additional Proofs [sic]" filed confidentially by the Defense for Drago Josipovic on 2 October 2000, the "Motion for Additional Evidence" filed by the Defense for Drago Josipovic on 31 August 2000, and the "Motion of the Counsel of Zoran and Mirjan Kupreskic for the Acceptance of Additional Evidence, Which Was Not Available at the Time of the Hearing Before the Trial Chamber (Rule 115 of the Rules of Procedure and Evidence)" filed confidentially by the Defense for Zoran and Mirjan Kupreskic on 4 October 2000 (together "the Motions");

CONSIDERING that the Order needs no further clarification;

REAFFIRMS that the Prosecution may respond to Vlatko Kupreskic’s Motion for Admission of Additional Evidence, as well as to the Motions, ten days after the date that the documents submitted with the Motions are filed in an official language of the International Tribunal.
