THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal");

BEING SEISED of "Answer of the Counsel of Drago Josipovic at the Order of the Hearing Council From 20.5.1998" (Official Record at Registry Page (‘RP’) D2041-D2042), "Answer of the Counsel of Vladimir Santic at the Order of the Hearing Council From 20.5.1998" (RP D2044-D2045), and "Defence Answer to the Trial Council Order From May 20. 1998" (RP D2037-D2039) all filed on 31 July 1998, and the "Motion of the Counsels of the Accused Zoran and Mirjan Kupreskic Considering the Order of the Hearing Council From 20.5.1998" (RP D2062-D2064) filed on 5 August 1998;

NOTING its Scheduling Order of 20 May 1998 (RP D1109-D1111);

CONSIDERING the "Prosecutor’s Response to the Answer of Accused, Dragan Papic" (RP D2057-D2060) filed on 5 August 1998;

CONSIDERING FURTHER that defence counsel may need additional time to respond to the Prosecutor’s Pre-Trial Brief (RP D1932-D1963) filed on 13 July 1998 ("the Brief");

CONSIDERING FURTHER Article 21 of the Statute of the International Tribunal which safeguards the right of the accused to a fair trial, and in particular the right to have adequate time and facilities for the preparation of his defence;

PURSUANT TO RULE 54;

HEREBY ORDERS that the Defence shall by Friday 14 August 1998 at 13:00 hours submit a joint or separate response to the Brief setting out those points, if any, of the indictment and the Brief which are admitted, those which are denied and the grounds for so doing, and setting out in general terms the defence to the indictment.
