TRIAL CHAMBER II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

CONSIDERING the Pre-Defence Conference held pursuant to Rule 73 ter of the Rules of Procedure and Evidence on 14 October 1998 in which the Trial Chamber, inter alia, requested the defence to file any admissions and to state which matters of fact or law are in dispute and which are not in dispute,

NOTING the following relevant materials which have been filed pursuant to the said request:

 CONSIDERING that the purpose of conducting an expeditious trial will be served by inviting the Prosecution to file a brief in which it states which of the matters or points raised in the above-mentioned defence documents it does not dispute, so that the Defence may decide that it is not necessary to call witnesses on such matters or points,

FOR THE ABOVE REASONS,

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence,

INVITES the Prosecution to file by 17 December 1998 a brief in which it states which of the matters or points raised in the above-mentioned defence documents it does not dispute,
