I, MOHAMED BENNOUNA, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

HAVING BEEN APPOINTED as pre-trial Judge in this matter by virtue of an Order of the Trial Chamber dated 12 January 1999,

BEING SEISED OF a "Defence Motion for Extension of Time" filed on behalf of the accused, Mla|o Radic, on 25 January 1999, a "Request for the Extention of Time", filed on behalf of the accused, Milojica Kos, on 25 January 1999, and a "Defence Motion for Extend Time Limited", filed on behalf of the accused, Zoran Zigic, on 26 January 1999 (together the "Requests for Extension of Time"), in which counsel for the accused seek an extension of time for filing responses to pre-trial motions filed by the Office of the Prosecutor ("Prosecution"),

NOTING that counsel for the accused, Zoran Zigic, also seeks postponement of the date upon which the parties are to notify the Trial Chamber of the matters on which an oral hearing is required to 25 March 1999 and to postpone that hearing by one month from Tuesday 9 March 1999 to Friday 8 April 1999,

NOTING that the dates for filing of motions and responses in this matter and the date selected for hearing oral argument have been fixed by agreement with the parties at a status conference held on 10 December 1998, as confirmed by a Scheduling Order issued by the Trial Chamber dated 16 December 1998,

NOTING the Order Granting Request for Extension of Time issued on 13 January 1999, extending the period for filing of preliminary motions pursuant to Rule 72 of the Rules of Procedure and Evidence of the International Tribunal ("Rules") in this matter to 1 February 1999,

PURSUANT TO Rule 127 of the Rules

HEREBY GRANT the Requests for Extension of Time in part and ORDER as follows:

  1. the Defence for all four accused shall have until Monday 1 March 1999 to file their responses to the pre-trial motions filed by the Prosecution;
  2. the parties shall notify the Trial Chamber no later than Friday 5 March 1999 of the motions on which agreement cannot be reached and on which an oral hearing is requested; and
  3. all other dates fixed by the Scheduling Order of 16 December 1998, including the date for oral hearing, and the Order Granting Request for Extension of Time of 13 January 1999 remain unaffected.
