I, MOHAMED BENNOUNA, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

HAVING BEEN APPOINTED as pre-trial Judge in this matter by virtue of an Order of the Trial Chamber dated 12 January 1999,

BEING SEISED OF a "Request for leave to file a reply to ‘Prosecutor’s Reply to Defence Preliminary Motion’" filed on behalf of the accused, Mlado Radic, on 5 February 1999, in which counsel for the accused requests permission to file a written response to the "Prosecutor’s Reply to Defence’s Preliminary Motion" filed by the Office of the Prosecutor ("Prosecution") on 28 January 1999 ("the Prosecution Reply"),

NOTING that oral argument on the Defence Preliminary Motion is already scheduled to be heard on 9 and 10 March 1999,

CONSIDERING that the Defence has indicated that the Prosecution Reply raises "issues to be explained and argued in detail",

CONSIDERING that the Trial Chamber will benefit from receiving full briefs of argument from the parties prior to the hearing,

 

PURSUANT TO Rule 54 of the Rules

HEREBY GRANT the Request and ORDER that counsel for the accused, Mlado Radic,

shall have until Friday 19 February 1999 to file a written response to the Prosecutor’s Reply to Defence’s Preliminary Motion.
