THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

BEING SEIZED of a "Joint Request by the Government of Canada, the United Kingdom, and the United States of America for an Extension of Time for the Filing of Written Submissions and for an Oral Hearing", filed on 15 September 2005 ("Application"), in which the governments of Canada, the United Kingdom, and the United States of America ("Applicants") seek an extension of time in which to file written submissions to
27 September and an adjournment of the oral hearing from 4 October to 7 October 2005, as ordered by the Trial Chamber in its "Scheduling Order for Hearing on General Ojdanic’s Second Application for Orders to NATO and States for Production of Information", issued on
7 September 2005 ("Scheduling Order"),

CONSIDERING that Order (1) of the Scheduling Order requires NATO and any States which have not yet responded to the Second Application to respond in writing, if they intend to do so, by 20 September 2005, and does not relate to written submissions which responsive States may wish to make in advance of the oral hearing,

CONSIDERING THEREFORE that, if the Applicants wish to file written submissions in relation to matters they intend to raise at the hearing, they may do so by 27 September 2005 without seeking relief or permission from the Trial Chamber,

CONSIDERING that the Applicants do not provide sufficient justification for an adjournment of the hearing scheduled for 4 October 2005,

PURSUANT TO Rules 54 and 54 bis of the Rules,

HEREBY DENIES THE APPLICATION.
