2 [Open session]
3 [The accused entered court]
4 --- Upon commencing at 9.35 a.m.
5 JUDGE ORIE: Good morning to everyone.
6 Madam Registrar, would you please call the case.
7 THE REGISTRAR: Good morning, Your Honours. This is case
8 IT-09-92-T, the Prosecutor versus Ratko Mladic.
9 JUDGE ORIE: Thank you, Madam Registrar.
10 The Chamber was informed there was a preliminary matter to be
11 raised.
12 Mr. Lukic.
13 MR. LUKIC: Good morning, Your Honours. We have to raise one
14 issue, scheduling issue, that will appear this week. For the next
15 witness, RM157, the Defence asked for three and a half hours for
16 cross-examination. Unfortunately, in reviewing the documents and the
17 statement and seeing how many incidents this witness covered in his
18 statement, it's obvious that we cannot finish his cross in less than six
19 and a half to eight hours. And in the meantime, we tried to solve the
20 problem with the Prosecution, and I think that we'll be able to organise
21 everything in a way that it might be that we'll have to interrupt the
22 cross-examination of this witness, start the next witness, Mr. Banbury,
23 and then continue with this one because only Mr. Banbury has strict
24 scheduling.
25 JUDGE ORIE: Yes. Well, please appreciated that you have tried
Page 7950
1 to resolve the problem with the Prosecution as far as scheduling is
2 concerned. As far as the timing is concerned, the Chamber might re-visit
3 the way of cross-examination soon. We are still thinking about these
4 matters also time-wise.
5 Having said this, is there any other matter? Not.
6 Then we hear the -- I would like -- first of all, I would like to
7 put on the record publicly that by decision of the 15th of January of
8 this year it -- the Chamber has granted the Prosecution's request for the
9 augmentation of protective measures for witness RM009. And on the 17th
10 of January, the Chamber has granted the Prosecution's request to add
11 three documents to the Prosecution's 65 ter list to be used with
12 Witness RM009. Since the augmentation means that we'll hear the
13 testimony of this witness in closed session, we turn into closed session.

20 JUDGE ORIE: Thank you, Madam Registrar.
21 First of all, I would like to thank everyone who was assisting us
22 because the booths gave their approval, their consent, but of course it
23 was all the others who made it possible to conclude the testimony of the
24 witness today. That's highly appreciated by the Chamber.
25 We will adjourn for the day and we'll adjourn tomorrow, Tuesday,
