                           [Open session]

                           [The accused entered court]

                           --- Upon commencing at 9.34 a.m.

JUDGE ORIE:  Good morning to everyone in and around this

     courtroom.

Madam Registrar, would you please call the case.

THE REGISTRAR:  Good morning, Your Honours.

This is the case IT-09-92-T, the Prosecutor versus Ratko Mladic.

JUDGE ORIE:  Thank you, Madam Registrar.

As everyone can see, we are just the two Judges today.  For

urgent personal reasons Judge Fluegge is unable to sit not only today but

most likely for the four days, all days of this week.  Judge Moloto and I

have considered whether it would be in the interests of justice to

continue to hear the case.  We decided that it was, and therefore, we'll

sit under Rule 15 bis for the remainder of this week.

The Chamber was informed that there was one preliminary matter to

be raised by the Prosecution.  Can we remain in open session or would you

     rather go into private session?

MR. McCLOSKEY:  Private session, please, Mr. President.

JUDGE ORIE:  Could we move into private session.
