TRIAL CHAMBER II ("Trial Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal"),
BEING SEISED of the "Request by the Radic Defence to the Trial Chamber to Review the Registrar’s Decision dated 07.10.2003", filed on 27 October 2003 ("Motion") by the Defence Counsel for Miroslav Radic ("Radic"), requesting the Trial Chamber to review the Decision of the Registrar of the Tribunal ("Registrar") dated 7 October 2003 ("Registrar’s Decision")1;
NOTING that the Registrar’s Decision determines that Radic should bear the costs of 223 hours of investigative and legal assistance work at the pre-trial stage;
NOTING that Radic argues in the Motion that the Registrar’s Decision does not contain "sufficient reasons" for concluding that Radic should partially remunerate counsel;2
PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the Tribunal;
HEREBY DIRECTS the Registrar to file by 12 January 2004 (i) copies of any material upon which the Registrar based the Registrar’s Decision; and (ii) comments on the Motion (collectively "Registrar’s Submission");
AND ORDERS Radic to file comments by 26 January 2004 on the Registrar’s Submission, with specific reference as to how the Registrar may have failed to comply with the legal requirements governing the Registrar’s Decision.
