THE TRIAL CHAMBER,

HAVING CONSIDERED the Motion Seeking the Leave for the Additional Filing ("Motion") filed by counsel for the accused, Hazim Delic, on 26 September 1996, seeking leave to file a Reply to Prosecutor’s Response to Delic’s Motion on the Form of the Indictment ("Reply"), which Reply was first submitted to the International Tribunal on 3 September 1996;

HAVING CONSIDERED the reasons given in support of the Motion;

NOTING that, at the hearing of the Motion on the Form of the Indictment held on 1 October 1996, the Office of the Prosecutor confirmed that it had no objection to the filing of the Reply;

NOTING that, in addition to matters relevant to the Motion on the Form of the Indictment, the Reply seeks to raise objections as to lack of jurisdiction of the International Tribunal, which objections are untimely raised and for which no showing of good cause has been made;

PURSUANT TO RULE 54 of the Rules of Procedure and Evidence of the International Tribunal,

AND WITH THE AGREEMENT OF THE PARTIES,

HEREBY GRANTS the Request and accepts the filing of the Reply insofar as relates to the Motion on the Form of the Indictment.
