THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal");

NOTING the "Scheduling Order" dated 24 April 1998 (Official Record at Registry Page ("RP") D6097-D6099);

FURTHER NOTING "The Co-defendant Mr. Mucic’s respectively Lead counsel’s Brief and Response to the Scheduling Order of the Honorable Trial Chamber dated 24 April 1998" filed by the accused Zdravko Mucic on 15 May 1998 (RP D6122-D6147) ("Response");

CONSIDERING the Response inappropriate and insufficient in fulfilling the obligations of the Defence for Mr. Mucic pursuant to the Scheduling Order;

FURTHER CONSIDERING the Response to be unacceptable as a document filed with the International Tribunal, in the quality of its language, its attacks on the Office of the Prosecutor and its impuning of the proceedings of the International Tribunal itself;

EXPRESSING CONCERN that there has been a pattern of filing documents of such disrespectful nature and that this should cease immediately;

PURSUANT TO RULE 54 of the Rules of Procedure and Evidence ("Rules"),

HEREBY ORDERS that

(1) The Defence for Zdravko Mucic file with the Registry for service on the other defendants, the Trial Chamber and the Office of the Prosecutor, by 20 May 1998:

(a) a list of its expert witnesses, stating the order in which they are to appear, the counts of the Indictment to which each will testify and the expected length of their examination in chief and,

(b) notice for each expert witness, consisting of the name of each witness, a curriculum vitae and a statement of the areas about which each witness will testify;

(2) The Defence for Zdravko Mucic file confidentially with the Registry for service on the other defendants and the Trial Chamber, a complete list of the witnesses which it intends to call, stating the order in which they are to appear, a summary of the evidence including the counts of the Indictment to which each witness is to testify and the expected length of their examination in chief, by 20 May 1998;

HEREBY NOTES that should the present Order not be complied with in full, to the satisfaction of the Trial Chamber, by the abovementioned date, the Trial Chamber shall consider taking the matter further, pursuant to Rule 46 of the Rules.
