THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991;
BEING SEISED of a Motion to Withdraw Counts 9 and 10 of the Indictment ("Motion") filed under Rule 50(A) of the Rules of Procedure and Evidence of the International Tribunal ("Rules") by the Office of the Prosecutor ("Prosecution") on 14 April 1997;
CONSIDERING that by the Motion, the Prosecution seeks leave to withdraw counts 9 and 10 of the Indictment;
PURSUANT TO RULE 50(A),
HEREBY GRANTS the Prosecution leave to withdraw counts 9 and 10 of the Indictment with prejudice such that the charges set forth in the said counts shall not be raised against any of the four accused persons at a later date.
