DECISION ON MOTION FOR AN EXTENSION TO SUBMIT THE PRE-TRIAL BRIEF

TRIAL CHAMBER I of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 (hereafter "Tribunal"):
BEING SEISED of the "Motion for an Extension to Submit the Pre-Trial Brief" filed by counsel for the accused Martinovic on 20 November 2000 (hereafter "the Motion"), seeking an extension of time until 27 November 2000 for filing the pre-trial brief of the accused Vinko Martinovic;
NOTING that, pursuant to her Scheduling Order dated 27 October 2000, Judge Patricia Wald, as Pre-Trial Judge in this matter, noted that the pre-trial brief of the Prosecutor was expected to be filed with the Chamber by 3 November 2000; and ordered that the Defence file their respective pre-trial briefs within two weeks of that date, namely by 20 November 2000;
NOTING that the pre-trial brief of the Prosecutor was not translated and filed with the Chamber until 11 November 2000;
NOTING that the Pre-Trial Conference has been scheduled for 7 December 2000;
NOTING that Rule 65 ter (F), empowers the pre-trial Judge to set a time limit for the Defence to file a pre-trial brief, providing that it is not later than seven days before the Pre-Trial Conference;
FINDING that it is in the interests of justice to extend the time limit for counsel for the accused Naletilic and Martinovic to file their respective pre-trial briefs, until 27 November 2000.
FOR THE FOREGOING REASONS
GRANTS the Motion and
ORDERS that the respective pre-trial briefs for the accused Martinovic, and the accused Naletilic be filed on or before 27 November 2000.
