I, Judge Patricia Wald, acting as Pre-Trial Judge in this matter for Trial Chamber I of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991;

ORDER that a Status Conference be held on Thursday, 14 September 2000, at 3:30 p.m.;

ORDER the parties to be prepared to discuss the following matters:

1) Disclosure of materials pursuant to Rules 66 and 68;

2) The possibility of reducing the number of issues in dispute through judicial notice pursuant to Rule 94; as a starting point, the parties should be prepared to discuss the susceptibility to judicial notice of those facts disputed by Mr. Naletilic but agreed to by Mr. Martinovic that are contained in paragraphs 1-6, 11-12, 15-21, 68-70, 142, 158 of the "First Filing of List of Facts in Dispute and Facts Not in Dispute" dated 27 July 2000, as well as those facts disputed by both accused contained in paragraphs 9, 23, 50, 156 of that same filing, and any other facts or documentary evidence that either party contends should be the subject of judicial notice;

3) With respect to the Prosecutor’s list of potential witnesses, ways of reducing the total number of witnesses or limiting the total amount of time allowed for the Prosecution’s case-in-chief, including depositions before a presiding officer pursuant to Rule 71 and submission of affidavits pursuant to Rule 94 ter;

4) Schedule for the submission of reports by expert witnesses to the Trial Chamber pursuant to Rule 94 bis;

5) Progress towards completing the pre-trial filings required by Rule 65 ter, including the list of exhibits the Prosecutor intends to offer and whether the Defence is expected to have any objections to authenticity;

6) The upcoming schedule, which is tentatively set as:

  • 29 September – deadline for Prosecution’s Rule 65 ter filings, motion for judicial notice, and any other pre-trial motions that the Prosecution currently intends to file, including motions regarding the intended use of depositions under Rule 71 or affidavits under Rule 94 ter;

  • 13 October – deadline for Defence’s Rule 65 ter filings, any other pre-trial motions that the Defence currently intends to file, and responses to any Prosecution motions;

  • 27 October – Final pre-trial conference.
