2 [Open session]
3 [The accused entered court]
4 --- Upon commencing at 2.15 p.m.
5 JUDGE ANTONETTI: [Interpretation] Registrar, kindly call the case,
6 please.
7 THE REGISTRAR: Good afternoon, Your Honours. This is case number
8 IT-04-74-T, the Prosecutor versus Prlic et al. Thank you, Your Honours.
9 JUDGE ANTONETTI: [Interpretation] Thank you, registrar.
10 Today we are Monday afternoon. I'd like to greet all the people
11 in the courtroom, representatives of the Prosecution, Defence counsel, the
12 accused, as well as all the people present in this courtroom.
13 Before I give the floor to Mr. Murphy, I would like to give the
14 floor to the registrar so he can give us IC numbers.
15 THE REGISTRAR: Thank you, Your Honour. Several parties have
16 submitted lists of documents to be tendered through Witness E. The list
17 submitted by the OTP shall be given Exhibit number IC 654; the list
18 submitted by 2D shall be given Exhibit number IC 655; the list submitted
19 by 4D shall be given Exhibit number IC 656; the list submitted by 5D shall
20 be given Exhibit number IC 657; and the list submitted by 6D shall be
21 given Exhibit number IC 658. Thank you, Your Honours.
22 JUDGE ANTONETTI: [Interpretation] Thank you, registrar.
23 Mr. Murphy, you have the floor.
24 MR. MURPHY: Thank you very much, Your Honour. Good afternoon,
25 Mr. President, Your Honours, everyone in the courtroom.

1 I think we're getting a transcript from a different proceeding, at
2 least I am on my screen. At least on the passive screen we're getting
3 today's but not on our screens. I think I can proceed because we are
4 getting it at least on the official screen.
5 Your Honour, I just wanted to take a moment to formally introduce
6 to the Trial Chamber Mr. Karim Khan, who will be taking over for me as
7 co-counsel for Mr. Stojic in the very near future.
8 Your Honour, Mr. Khan is a member of the English bar, and he has
9 had experience not only at this Tribunal but also at the special courts in
10 Sierra Leone and East Timor, and in addition to many other distinctions is
11 the co-author of Archbold on international courts. So he is a recognised
12 authority on international criminal law, and I think all I need say in
13 that regard is that under Ms. Nozica's leadership we will be continuing,
14 on behalf of the Stojic Defence, to provide the Trial Chamber with a very
15 high level of assistance in all respects. So, Your Honour, I hope
16 everyone will welcome Mr. Khan as they have me into the proceedings.
17 JUDGE ANTONETTI: [Interpretation] Thank you, Mr. Murphy. On
18 behalf of my colleagues and Mr. Mindua who will join us in a few moments,
19 I would like to welcome Mr. Khan, who has joined Mr. Stojic's Defence
20 team. We have, of course, acknowledged the fact or acknowledged the
21 resume of this new Defence lawyer, and as soon as I have time I will read
22 the book he wrote on international courts.
23 So welcome, Mr. Khan.
24 I shall now give the floor to Mr. Kovacic, who was on his feet at
25 some point in time.

1 MR. KOVACIC: [Interpretation] Your Honour, thank you. Good
2 afternoon to everybody, the Trial Chamber, and everybody else in the
3 courtroom. I just wanted to make a brief request, Your Honours. This
4 morning we received from the Prosecution an addendum to the proposal for
5 protective measures for Witness C who we're going to hear today, and I'd
6 just like to remind you that the Prosecution submitted a written proposal
7 earlier and the Defence of Petkovic and Praljak responded in writing, and
8 today we've received an additional part to that document. From the letter
9 I see that the Trial Chamber has received a copy as well, and I would just
10 like to state clearly for the record -- or, rather, to inform the Trial
11 Chamber for the record that we cannot see any objective reasons. We can
12 see some subjective fears and concerns on the part of the witness but none
13 of them are objective.
14 JUDGE ANTONETTI: [Interpretation] Let's move into private session.
15 Registrar, closed session please.
