 3                          [The accused entered court]

 4                          --- Upon commencing at 9.00 a.m.

5            JUDGE ANTONETTI: [Interpretation] Madam Registrar, please call the

 6    case.

7            THE REGISTRAR:  Good morning, Your Honours.  This is case number

8    IT-04-74-T, the Prosecutor versus Jadranko Prlic et al.

9            JUDGE ANTONETTI: [Interpretation] Thank you.  Today is Thursday,

10    29th of November.  My greetings to all the people in the courtroom, the

11    Prosecution representatives, the Defence counsel, and the accused.

12            First, I shall give the floor to the registrar, good morning to

13    her, and to all those who assist us.  I need three IC numbers, don't I.

14            THE REGISTRAR:  Your Honours, list of Prosecution exhibits

15    tendered through Witness Amor Masovic will become Exhibit IC 733.

16            Pusic Defence additional request for the admission of documents

17    tendered through Witness Masovic will become Exhibit IC 734.

18            The list of Prosecution exhibits tendered through Witness BC will

19    become Exhibit IC 735, under seal.

20            JUDGE ANTONETTI: [Interpretation] Thank you.  The Trial Chamber is

21    going to hand down two oral decisions.  I shall try to be quick, but these

22    are urgent decisions to be issued.

23            First oral decision:  On the 27th of November, 2007, the

24    Prosecution filed a motion for admission of documents related to Witness

25    EA.  The Trial Chamber recalls that further to two decisions handed down

Page 25312

1    on the 13th of July and on the 29th of November, 2006, the Prosecution is

2    allowed to tender documents either through witnesses in court or by

3    written motion related to a specific municipality or topic.

4            The Trial Chamber notes that this motion does not meet the

5    guidelines set forth by the Trial Chamber for admission of documentary

6    evidence, in that it is not linked to a specific municipality or topic.

7    Furthermore, the Prosecution has already filed two motions for admission

8    of evidence linked to Witness EA:  The first time in a written motion

9    filed on the 5th of July, 2007, and the second time in an oral motion for

10    admission of evidence through Witness EA on the 26th of November, 2007;

11    the IC number being 00722.

12            The evidence thus presented by the Prosecution with regard to

13    Witness EA amounts to some 120 documents.  Given that the Prosecution is

14    under the obligation to select the most important documents and to tender

15    them whilst meeting the guidelines, the Trial Chamber has decided to turn

16    down or dismiss the motion.

17            Second oral decision:  It has to do with a deadline for filing

18    Prosecution motions.

19            The Trial Chamber requests the Prosecution to file any motion by

20    the 10th of December, 2007.  This will enable the Trial Chamber to rule in

21    due time by the end of the Prosecution case scheduled on the 24th of

22    January, 2008.

23            So with regard to the second oral decision, as of the 10th of

24    December, 2007, the Trial Chamber will no longer accept any new motion.

25            Let us move into private session, please.
