I, Judge Florence Mumba, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991,

HAVING BEEN APPOINTED as pre-trial Judge in this matter by virtue of an order of the Trial Chamber dated 3 September 2001,

BEING SEISED of a "Prosecutor’s response to the Chamber’s request to consider the retention of particular witnesses on the Prosecutor’s witness list" (the "Request"), filed by the Office of the Prosecutor (the "Prosecution") on 6 July 2001, in which the Prosecution requests to be allowed to call to give evidence eight witnesses, witnesses 3, 6, 7, 10, 11, 19, 30 and 33 (the "Witnesses"), whose evidence Trial Chamber III suggested may be repetitive at the pre-trial conference held on 26 June 2001,

CONSIDERING that, in its Request, the Prosecution notified the Chamber of its intention not to call five of the thirteen witnesses identified by Trial Chamber III as potentially repetitive (witnesses 4, 8, 16, 18 and 26), and further proposed to remove four further witnesses (witnesses 39, 43, 44 and 46) from its witness list,

CONSIDERING the specific reasons set out by the Prosecution in respect of each of the witnesses sought to be maintained on its witness list,

HEREBY GRANT THE MOTION.
