THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal"),

NOTING the various motions now pending before the Trial Chamber, including a "Pre-trial Motion by the Prosecution Requesting the Trial Chamber to take Judicial Notice of the International Character of the Conflict in Bosnia-Herzegovina" filed by the Office of the Prosecutor ("Prosecution") on 16 December 1998 ("the Motion for Judicial Notice"), a "Prosecution Motion to resolve Conflict of Interest" filed by the Prosecution on 16 December 1998 ("the Motion regarding Conflict of Interest"), a "Request for Provisional Release of the Accused, Mr. Simo Zaric" filed on 19 January 1999 and a "Request for Provisional Release of Mr. Miroslav Tadic" also filed on 19 January 1999 (together the "Requests for Provisional Release"),

NOTING the Defence Response to the Motion regarding Conflict of Interest filed on behalf of the accused, Simo Zaric, on 21 January 1999,

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY ORDERS as follows:

  1. the Defence shall each file their responses to the Motion for Judicial Notice by Wednesday 3 February 1999;
  2. the Defence for the co-accused, Milan Simic, Miroslav Tadic and Stevan Todorovic, shall file their response, if any, to the Motion regarding Conflict of Interest by Wednesday 3 February 1999;
  3. the Prosecution shall file its responses to the Requests for Provisional Release by Wednesday 3 February 1999;
  4. the Defence for the accused, Stevan Todorovic, shall file its preliminary motions by Wednesday 10 February 1999;
  5. the Prosecution shall file its responses to any such preliminary motions by Monday 22 February 1999;
  6. the Prosecution shall file any other motions concerning pre-trial issues by Wednesday 10 February 1999;
  7. the Defence shall have until Monday 22 February 1999 to respond to any such motions;
  8. the Trial Chamber will hear oral argument on all of the above motions on Tuesday 23 February 1999, commencing at 10 a.m. and continuing on Wednesday 24 February 1999 at 2 p.m. if required;
  9. All accused shall be present for these proceedings, save that the accused Milan Simic may be represented by his counsel;
  10. the Prosecution shall provide to the Defence on or before Tuesday 23 February 1999, in a language the accused understand, the supporting material which accompanied the amended indictment when confirmation was sought.
