THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of a "Prosecutor’s Motion for judicial notice of facts of common knowledge and adjudicated facts" filed by the Office of the Prosecutor ("Prosecution") on 10 February 1999 ("the Motion"),

HAVING HEARD the oral arguments of the parties on the Motion at the pre-trial conference held on 29 April 1999, including the report of the Prosecution as to further negotiations between the parties on this matter,

HAVING HEARD the position of the parties at the pre-trial conference held on 29 April 1999 as to readiness for trial and other matters,

PURSUANT TO Rules 54 and 73 bis of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY ORDERS as follows:

  1. the Prosecution shall by Friday 14 May 1999, and in consultation with the Defence, file a list of agreed facts for consideration by the Trial Chamber in connection with the Motion;
  2. the Prosecution shall by Friday 14 May 1999 file any admissions and a statement of other matters which are not in dispute pursuant to Rule 73 bis (ii);
  3. the Defence shall file their pre-trial briefs by Monday 31 May 1999;
  4. the Prosecution shall file its list of the order of witnesses by Tuesday 1 June 1999;
  5. subject to further order, the trial in this matter shall commence on Tuesday 22 June 1999, commencing at a time to be announced.

All accused are to be present at the seat of the International Tribunal throughout the period of the trial.
