Prosecutor v. Slobodan Milosevic

DECISION

THE REGISTRAR,

CONSIDERING the Statute of the Tribunal as adopted by the Security Council under Resolution 827 (1993), and in particular Article 21 thereof;

CONSIDERING the Rules of Procedure and Evidence as adopted by the Tribunal on 11 February 1994, as subsequently amended, and in particular Rule 54 and Rule 74;

CONSIDERING the Order Inviting Designation of Amicus Curiae, issued by Trial Chamber III on 30 August 2001 in Case No. IT-99-37-PT, in which the Trial Chamber invited the Registrar to designate counsel to appear before it as amicus curiae;

CONSIDERING the Decision of the Registrar dated 6 September 2001, in which the Registrar designated Professor Michaïl Wladimiroff, Mr. Stephen Kay Q.C., and Mr. Branislav Tapuskovic as amici curiae in Case No. IT-99-37-PT, and states that for the purpose of assisting the Court, the amici shall be subject to the Code of Professional Conduct for Defence Counsel Appearing Before the International Tribunal (hereinafter "the Code of Conduct");

CONSIDERING the Order Inviting Designation of Amicus Curiae, issued by Trial Chamber III on 30 October 2001 in Case No. IT-01-50-PT, in which the Chamber invited the Registrar to designate the same three counsel to appear before it as amici curiae;

CONSIDERING the Decision of the Registrar dated 30 October 2001 in which the Registrar designated Professor Wladimiroff, Mr. Kay Q.C., and Mr. Tapuskovic as amici curiae in Case No. IT-01-50-PT, and states that for the purpose of assisting the Court, the amici shall be subject to the Code of Conduct;

CONSIDERING the Order Inviting Designation of Amicus Curiae, issued by Trial Chamber III on 23 November 2001 in Case No. IT-01-51-PT, in which the Chamber invited the Registrar to designate the same three counsel to appear before it as amici curia;

CONSIDERING the Decision of the Registrar dated 27 November 2001, in which the Registrar designated Professor Wladimiroff, Mr. Kay Q.C., and Mr. Tapuskovic as amici curiae in Case No. IT-01-51-PT, and states that for the purpose of assisting the Court, the amici shall be subject to the Code of Conduct;

CONSIDERING the Decision on Prosecution Interlocutory Appeal From Refusal To Order Joinder, issued by the Appeals Chamber on 1 February 2002, in which the Appeals Chamber ordered that the three indictments against Slobodan Milosevic (IT-99-37-I, IT-01-50-I, IT-01-51-I) shall be tried together in one trial and that for the purpose of that one trial, the three indictments shall be deemed to constitute one indictment, with one case number;

CONSIDERING the Certificate issued by the Registrar on 4 February 2002, which designated the case number IT-02-54-PT to the joined case of the Prosecutor v. Milosevic;

CONSIDERING the Decision Concerning an Amicus Curiae, issued by Trial Chamber III on 10 October 2002 in Case No. IT-02-54-T, in which the Chamber instructs the Registrar to revoke the appointment of Professor Wladimiroff as an amicus curiae;

NOTING that in accordance with Article 9(D) of the Code of Conduct (IT/125 Rev.1), Professor Wladimiroff is obliged to surrender any papers and property to which the Tribunal is entitled;

NOTING that in accordance with Article 13(A) of the Code of Conduct, Professor Wladimiroff remains subject to a continuing duty of confidentiality;

HEREBY DECIDES to revoke the appointment of Professor Wladimiroff as an amicus curiae in Case No. IT-02-54-T, effective immediately.
