THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of "Amicus Curiae’s Request for Approval to Identify Relevant Trial Documents in Person for the Completion of Written Submissions and for Further Extension of Time", filed by the amicus curiae, Professor Timothy McCormack on 26 June 2003 ("Request"),

NOTING that submissions on the applicable law of self-defence and its current status under customary and conventional international law will be produced by the due date of 14 July, 2003,

NOTING the request by the amicus curiae for the Trial Chamber’s authorisation to travel to The Hague for the period 28 July to 1 August 2003 to examine the documentation relevant to the preparation of submissions on self-defence as it has arisen in the Kosovo part of the case,

NOTING the difficulties experienced by the amicus curiae in having the relevant documentation transmitted by the Registry to him in Melbourne, Australia,

CONIDERING that this part of the amicus curiae’s mandate cannot be discharged unless he has access to the relevant documentation, including the transcript of the evidence,

CONIDERING that it is implicit in the amicus curiae’s mandate that he would be required to travel to The Hague in the discharge of his functions,

PURSUANT TO Rules 54 and 74 of the Rules of Procedure and Evidence

HEREBY ORDERS AS FOLLOWS:

  1. That the time for filing submissions on self-defence as it has arisen in the Kosovo part of the case shall be extended to 14 October, 2003;
  2. That the Registrar should make the necessary arrangements for the amicus curiae to travel to The Hague for the period 28 July to 1 August 2003 for the purposes of examining the documentation relevant to the preparation of submissions on self-defence as it has arisen in the Kosovo part of the case, and for any other period when the amicus curiae considers it necessary for the discharge of his functions.
