THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),
BEING SEISED OF a "Defence Request For Leave to File A Reply To The Prosecution’s Response to Defence Preliminary Motion" filed on 17 September 2003 ("Request") by the Defence of Franko Simatovic ("Accused"), requesting leave to file a reply,
NOTING the "Defence Preliminary Motion" filed on 3 September 2003 ("Motion") by the Defence of the Accused, alleging numerous defects in the form of the indictment against the Accused,
NOTING the "Prosecution’s Response To Defence Preliminary Motions On The Form Of The Indictment" filed on 15 September 2003 ("Response") by the Office of the Prosecutor ("Prosecution"), requesting the Trial Chamber to deny the Motion,
NOTING that the Defence of the Accused "feels the need to clarify certain crucial issues that the Prosecution has raised,"1
PURSUANT TO Rule 126 bis of the Rules of Procedure and Evidence of the International Tribunal,
HEREBY GRANTS the Request and ORDERS the Defence to file its reply no later than 22 September 2003.
