THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),
BEING SEISED of a confidential "Defence Motion for Provisional Release" filed by counsel for the accused, Franko Simaotovic, on 30 January 2004, and the "Prosecution’s Response to Simatovic’s ‘Defence Motion for Provisional Release’" filed by the Office of the Prosecutor ("Prosecution") on 13 February 2004,
BEING SEISED also of a "Defence Request to File a Reply to the Prosecution’s Response to Confidential Defence Request for Provisional Release and Defence Request for Extension of Time to File Sought Reply" filed by counsel for the accused, Franko Simatovic, on 19 February 2004 ("the Motion"), seeking leave to file a reply and an extension of time to Tuesday 24 February 2004 in which to file such reply,
NOTING the reasons given in support of the Motion,
CONSIDERING that it would assist the Trial Chamber to have the benefit of a reply from the defence as outlined in the Motion,
PURSUANT TO Rules 54 and 126 bis of the Rules of Procedure and Evidence of the International Tribunal
HEREBY GRANT the Motion and ORDER the defence for Franko Simatovic to file its reply no later than Tuesday 24 February 2004.
