5 --- Upon commencing at 9.04 a.m.
6 JUDGE ORIE: Good morning to everyone.
7 Madam Registrar, would you please call the case.
8 THE REGISTRAR: Good morning, Your Honours. Good morning,
9 everyone in and around the courtroom. This is case number IT-03-69-T,
10 the Prosecutor versus Jovica Stanisic and Franko Simatovic.
11 JUDGE ORIE: Thank you, Madam Registrar.
12 Good morning, Mr. Jordash.
13 MR. JORDASH: Good morning. May I apologise for keeping the
14 Court waiting. It was my fault entirely.
15 JUDGE ORIE: Yes, well it's more exception than rule. We accept
16 your apologies.
17 Mr. Bakrac, are you ready to continue your cross-examination?
18 MR. BAKRAC: [Interpretation] Yes, Your Honour. Thank you.
19 JUDGE ORIE: Witness JF-047, I would like to remind you that
20 you're still bound by the solemn declaration you've given yesterday. I
21 also have to apologise because I don't think that I instructed you
22 yesterday that you should not speak with anyone about your testimony
23 which you're not allowed to do. Did you speak with anyone about your
24 testimony yesterday?
25 THE WITNESS: [Interpretation] No, Your Honour.
Page 7684
1 JUDGE ORIE: Then the consequences of my mistake are apparently
2 non-existent. Nevertheless, I apologise also to the parties for this
3 failure.
4 Mr. Bakrac, you're ready. Please proceed.
5 MR. BAKRAC: [Interpretation] Thank you, Your Honour.
6 WITNESS: JF-047 [Resumed]
7 [Witness answered through interpreter]
8 Cross-examination by Mr. Bakrac: [Continued]
9 Q. [Interpretation] Witness --
10 JUDGE ORIE: And could you please keep in mind what would be the
11 appropriate moment to turn into private session. Please proceed.
12 MR. BAKRAC: [Interpretation] Thank you, Your Honour. I think
13 that my first question will not require a private session.
14 Q. Witness, you told us yesterday that while you were at Pajzos on
15 two occasions you saw Mr. Simatovic, and then that you also saw him at
16 the briefing; correct?
17 A. Yes, that's correct.
18 Q. Witness, after the briefing when you left for Bosnia, have you
19 ever seen Mr. Simatovic since?
20 A. Yes.
21 Q. Could you tell us when and where?
22 A. On the 17th of April, 1993, on the occasion of the celebration of
23 the liberation of Bosanski Samac, he was passing through and he was in
24 company with Mr. Zvezdan Jovanovic.
25 Q. So you say he was passing through. Did you ever see him since?
Page 7685
1 A. No, not in person.
2 Q. Witness --
3 MR. BAKRAC: [Interpretation] Your Honour, could we now please
4 move into private session.
5 JUDGE ORIE: We move into private session.
