 2                           [Open session]

 3                           [The accused entered court]

 4                           --- Upon commencing at 9.05 a.m.

5             JUDGE ORIE:  Good morning to everyone.

6             Madam Registrar, would you please call the case.

7             THE REGISTRAR:  Good morning, Your Honours.

8             This is the case IT-03-69-T, the Prosecutor versus

9     Jovica Stanisic and Franko Simatovic.

10             JUDGE ORIE:  Thank you, Madam Registrar.

11             Before we move into closed session, I'd like to put one thing on

12     the record.  The pseudonym sheet for the witness who is, at present,

13     giving testimony was admitted under number D333.  When we admitted it, it

14     was not yet uploaded.  The pseudonym sheet now has been uploaded, and it

15     was -- the document ID was 1D05002.

16             We move into closed session.

18             THE REGISTRAR:  We're in open session, Your Honour.

19             JUDGE ORIE:  Thank you, Madam Registrar.

20             We have concluded the evidence of Witness DST-074.  For the next

21     witness, the protective measure of closed session is, if not permanently,

22     at least provisionally, ordered.

23             We'll take a break, and we'll resume at five minutes to 12.00.

24                           --- Recess taken at 11.44 a.m.

25                           --- On resuming at 12.02 p.m.

1             JUDGE ORIE:  Before we give an opportunity to the Defence to call

2     its next witness, which will testify in closed session, there was a

3     matter you'd like to raise, Mr. Groome, in private session.  Is that --

4             MR. GROOME:  Yes, Your Honour.

5             JUDGE ORIE:  Then we move into private session.

4   [Closed session]     [Confidentiality partially lifted by order of the Chamber]

5             THE REGISTRAR:  We're in closed session, Your Honours.

6             JUDGE ORIE:  Thank you, Madam Registrar.

 7                           [The witness entered court]

8             JUDGE ORIE:  Good afternoon, Witness DST-044.

9             THE WITNESS: [Interpretation] Good day.

10             JUDGE ORIE:  Before you give evidence in this court, the Rules of

11     Procedure and Evidence require that you make a solemn declaration that

12     you'll speak the truth, the whole truth, and nothing but the truth.  The

13     text is now handed out to you, and may I invite you to make that solemn

14     declaration.

15             THE WITNESS: [Interpretation] I solemnly declare that I will

16     speak the truth, the whole truth, and nothing but the truth.

17                           WITNESS:  DST-044

18                           [Witness answered through interpreter]

19             JUDGE ORIE:  Thank you, Witness DST-044.  Please be seated.

20             THE WITNESS: [Interpretation] Thank you.

21             JUDGE ORIE:  I used the pseudonym.  Perhaps that is wiser to do,

22     in order to still have full flexibility for the future.

23             Witness DST-044, we are in closed session at this moment.  I did

24     understand that you have not applied for any protective measures to be

25     ordered, but there was a request of the Republic of Serbia that you

Page 13363

1     testify in closed session.  Now, the Chamber has not finally decided

2     because the reasons given by the Republic of Serbia were not such that we

3     could, on the basis of those reasons, already decide that it would be

4     justified to hear your testimony in closed session.  At the same time, we

5     asked for further information.  This means that, although you're now

6     testifying in closed session, we could later decide that your testimony

7     will be public.  If there's any matter the parties would consider such

8     that it might justify non-public testimony, they'll put that on the

9     record.  But, just for you to be aware, no one sees you, no one hears

10     you, but that could change in the near future.

11             Is that clear to you?

12             THE WITNESS: [Interpretation] It's clear.

13             JUDGE ORIE:  Mr. Jordash, please proceed.

14             MR. JORDASH:  Thank you, Your Honour.

15             JUDGE ORIE:  You will now first be examined by Mr. Jordash.

16     Mr. Jordash is counsel for Mr. Stanisic.

17             Please proceed.

18             MR. JORDASH:  Thank you.

19                           Examination by Mr. Jordash:

20        Q.   Good afternoon, Mr. Witness.

21        A.   Good afternoon.

22             MR. JORDASH:  Please, could we have on the screen, 1D05011.

23             If you look at the screen in front of you, there will be a

24     document with some personal details.  Please have a look at it and

25     confirm whether it's accurate.

Page 13364

1             Well, I think the date may be wrong.

2        A.   The year of birth is 1953.

3        Q.   Yes.  Unless you're extremely old.  Sorry about that.  Thank you

 4     for the confirmation.

5             MR. JORDASH:  I'll reserve, if I may, tendering this until we've

 6     corrected that.

7             JUDGE ORIE:  I think it would be good to have another version to

 8     be uploaded.

 9             Please proceed.

10             MR. JORDASH:  Yes, apologies.

11             JUDGE ORIE:  But we already reserve a number for it.  The number

12     for the pseudonym sheet would be, Madam Registrar ...

13             THE REGISTRAR:  The number would be D370, Your Honour.

14             JUDGE ORIE:  Yes.  And we wait until the new version is uploaded

15     before we decide on admission.

16             Please proceed.

6        A.   Yes, that is the area.

7             MR. JORDASH:  May I tender this as an exhibit, please.

 8             MR. GROOME:  No objection.

 9             JUDGE ORIE:  Madam Registrar.

10             THE REGISTRAR:  This will be Exhibit D373, Your Honour.
