THIS BENCH of the Appeals Chamber of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991 ("International Tribunal"),

NOTING the "Appellant’s Brief" filed by Savo Todovic on 9 August 2005, pursuant to Rule 11bis of the Rules of Procedure and Evidence ("Rules");

NOTING the " Prosecution’s Response Brief" filed on 19 August 2005;

BEING SEIZED of the "Defence Motion for Extension of Time" filed by Savo Todovic on 22 August 2005 ("Motion for Extension of Time"), in which he requests an extension of time to file his reply to the "Prosecution’s Response Brief" by 26 August 2005;

NOTING that upon consultation the Prosecution has expressed that it does not oppose or support the Motion for Extension of Time;

CONSIDERING that the Motion for Extension of Time relies, inter alia, on the grounds that: (1) pursuant to the recent amendments to the Rules and to an order issued by the President of the International Tribunal, counsel for the Defence has to file Savo Todovic’s appeal brief pursuant to Rule 65 today1, (2) Defence counsel is also the Lead counsel in the case of Gojko Jankovic, whose appeal brief pursuant to Rule 11bis of the Rules is due tomorrow2, and (3) given the complexity of the issues concerning the referral proceedings, the "Prosecution’s Response Brief" raises a number of points to which the Defence wishes to reply3;

FINDING that good cause has been shown under Rule 127(B) of the Rules for granting an extension of time for the filing of Savo Todovic’s reply to the "Prosecution’s Response Brief";

HEREBY GRANTS the Motion for Extension of Time.
