I, Carmel Agius, Presiding Judge of Trial Chamber II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal");

NOTING the Indictment in the case The Prosecutor v. Zdravko Tolimir, Radivoje Miletić and Milan Gvero, confirmed by Judge Daqun Liu on 10 February 2005;

NOTING the two Decisions by Judge Daqun Liu dated 23 February 2005 and 25 February 2005 lifting the confidentiality of the Indictment against Radivoje Miletić and Milan Gvero and subsequently against Zdravko Tolimir;

NOTING that Radivoje Miletić and Milan Gvero (“Accused”) surrendered and were transferred to the seat of the Tribunal on 28 and 24 February 2005 respectively;

NOTING the Order by the President of the Tribunal dated 24 February 2005 and the Order of the Vice-President of the Tribunal dated 28 February 2005, both assigning the case against Radivoje Miletic and Milan Gvero to Trial Chamber II;

NOTING the Order of 1 March 2005 designating myself as judge of Trial Chamber II for the purpose of the initial appearance of the two Accused;

NOTING that the initial appearance of the two Accused has been scheduled for Wednesday 2 March 2005 at 12.00 hours in Courtroom 3;

HAVING CONSIDERED the request of certain members of the press;

PURSUANT TO Rule 81(D) of the Rules of Procedure and Evidence of the Tribunal;

HEREBY ORDER that, subject to any further order of the Trial Chamber:

  1. the taking of still photographs by designated press photographers at the commencement of all proceedings in this matter is authorised as directed by the Chief of Security of the Tribunal’s Security Service; and

  2. the release of the audio-visual record of all open sessions in this case is permitted as provided by the Registrar of the Tribunal.
