 2                           [Open session]

 3                           [The accused entered court]

 4                           --- Upon commencing at 2.18 p.m.

5             JUDGE FLUEGGE:  Good afternoon to everybody in the courtroom.

6             I see you're on your feet, Mr. McCloskey.

7             MR. McCLOSKEY:  Yes, good afternoon, Mr. President, Your Honours,

 8     everyone.

9             Just I have some translations uploaded now, just four exhibits

10     that I can read out, and if you would like.

11             JUDGE FLUEGGE:  Yes, please.

12             MR. McCLOSKEY:  P2222.  The next one is P2228.  The third is

13     P2234.  And, lastly, P2251.

14             JUDGE FLUEGGE:  Thank you very much.

15             This morning we received the response of the Defence to the

16     motion of the Prosecution, in relation to 98 bis.  I would like to ask

17     you, Mr. McCloskey, if you intend to reply.

18             MR. McCLOSKEY:  Yes, Mr. President.  I have spoken with

19     Mr. Thayer and Mr. Vanderpuye about it.  I would like to have a chance to

20     discuss a bit with Mr. Gajic.  But we should be able to get out a brief

21     reply fairly quickly, I think.

22             JUDGE FLUEGGE:  Can you please be a bit more specific?  "Fairly

23     quickly" can be everything.

24             MR. McCLOSKEY:  How about Tuesday?

25             JUDGE FLUEGGE:  Tuesday of next week.

 2                           [Trial Chamber confers]

3             JUDGE FLUEGGE:  We are okay with that, and we are looking forward

4     to receive your reply by Tuesday next week.

5             MR. McCLOSKEY:  Thank you.  We'll continue to discuss things, if

6     we can work anything out.  There are some interesting ideas and issues.

7     And if we can work something out, we'll get back to you sooner than that,

8     but we'll do our best.

9             JUDGE FLUEGGE:  If there are no other matters to discuss before

10     the witness is brought in, then we have to move into closed session

11     because we are hearing a witness with protective measures.  That means,

12     in this specific case, closed session.

13             We move into closed session.
