ICTY Weekly Press Briefing - 26 February 2014

Date: 26 February 2014

Magdalena Spalińska, Spokesperson for Registry and Chambers, made the following statement:

Good afternoon,

Following last week’s dismissal of the Defence motion for acquittal, the Hadzic Trial Chamber ordered on 20 February 2014 that the Defence case will start on 24 June 2014, after the pre-defence conference scheduled for 17 June 2014. The exact time and the courtroom will be determined later.

In the case of Lukic and Lukic, MICT President Meron assigned an Appeals Chamber to decide on Milan Lukic's application for review of the judgement, filed on 6 February. The Appeals Chamber consists of Judges Meron, Antonetti, Sekule, Agius and Liu. Lukic seeks the review on the basis of 4 witness statements allegedly presenting new facts.

In the case of Stanisic and Zupljanin the panel of three judges Flugge, Morrison and Baird, appointed by Judge Agius, the Acting ICTY President, denied the Defence's motion for recusal of Judge Liu from considering the Zupljanin's Motion to Vacate the Trial Judgement. The panel found that the Defence had not demonstrated a "reasonable apprehension of bias on the part of Judge Liu from the standpoint of a reasonable observer" and that Judge Liu, having previously dissented on the issue of disqualification of Judge Harhoff, would be unable to impartially decide on the Motion to Vacate the Trial Judgement." Judge Harhoff had been on the bench in the case of Stanisic and Zupljanin.

In the case of Ratko Mladic on Monday 24 February, the Prosecution filed a notice announcing that its case against Ratko Mladic has been rested. To remind, as Trial Chamber ordered earlier, the presentation of the Rule 98bis submissions should commence ‘on the 10th working day’ after the official closure of the Prosecution’s case.

Karadzic trial is scheduled to sit next Monday, 3 March, from 16:00 until 17:30 in courtroom 1 to hear the testimony of the last Defence’s witness, KDZ-584. On 20 February 2014, the Chamber in this case issued a scheduling order announcing that the Defence case shall be considered closed on the day when the Chamber issues it last decision on evidence-related motion.
