Good afternoon,

I will immediately turn to the upcoming courtroom schedule:

The Judgement in Vojislav Šešelj’s second contempt of court case will be rendered on Friday, 31 October at 8:00 am in Courtroom I. Šešelj is accused of breaching protection measures ordered by the Tribunal after he disclosed information about 11 protected witnesses, including their names, occupations and places of residence, in a book he authored. The Order in lieu of indictment was filed on 4 February 2010 and the trial commenced on 22 February 2011 and ended on 8 June 2011. A Press Advisory will be issued closer to the time as a reminder.

The next Status Conference in the case of Ratko Mladić will be held on Thursday, 10 November at a time and in a courtroom to be confirmed.

Proceedings in the trial of Jovica Stanišić and Franko Simatović as well as Mićo Stanišić and Stojan Župljanin continue this week and next as scheduled.

In the Stanišić and Simatović trial, the Trial Chamber is currently hearing the testimony of Milorad Leković, former chief of the Belgrade centre of the Serbian State Security Service, who is testifying via video-link.

In the  Stanišić and Župljanin trial, the Trial Chamber is currently hearing the testimony of Miloš Janković, former police officer and Chief of the Communications department of the Prijedor police station in 1992. He will be testifying for the rest of the week.

Hearings in the re-trial of Ramush Haradinaj will resume on Wednesday, 26 October at 9:00 am in Courtroom I, whilst proceedings in the trial of Radovan Karadžić will resume next Tuesday, 18 October, at 9:00 in Courtroom I.

Office of the Prosecutor:

Frederick Swinnen, Special Adviser to the Prosecutor, made no statement.

Questions:

Asked what the reasons were for Dragomir Pećanac’s refusal to testify in the trial of Zrdavko Tolimir, Nerma Jelačić responded that he has submitted some of the reasoning in the filings which are to date still confidential. She added that the confidentiality of the filings should be lifted in a few days time, together with all the other documents including the order for arrest and the indictment. Pećanac’s further initial appearance should be held sometime next week.

Asked whether Pećanac has ever been called before to testify in other cases, Jelačić responded that she would not be able to confirm.

Asked to comment on recent reports in the media regarding an interview with the Prosecutor during which he announced that he was intending to file new motions in order to speed up proceedings in the trial of Ratko Mladić and asked whether this had anything to do with the current medical treatment of the Accused, Frederick Swinnen responded that the interview with the Prosecutor took place before the recent medical issue arose and that the Prosecutor was referring to the regular motions which are filed prior to the start of every trial. These include proposals to submit written evidence, such as witness statements pursuant to rules 92bis and 92ter and the proposal to take notice of adjudicated facts from previous proceedings. These motions will be filed in the coming weeks and months, as the Prosecution has done in all other trials.

Asked whether there were any updates on the health status of Ratko Mladić, Nerma Jelačić confirmed that he is still receiving medical treatment but that, in accordance with the confidentiality rules, she cannot confirm what he is being treated for.

Asked whether he is being treated in an external hospital, Jelačić responded that in accordance with the rules regarding the security and safety of the accused, she cannot disclose the whereabouts of the Accused.
