Refik Hodžić, Spokesman for Registry and Chambers, made the following statement:
President Pocar submitted on Monday to the UN General Assembly the 13th Annual Report of the International Criminal Tribunal for the former Yugoslavia. The full text of the report can be found on our website.
SCHEDULE:
Apart from the ongoing proceedings in the cases Prlić et al, Milutinović et al, Milan Martić and Mrkšić et al., there is an initial appearance of Domagoj Margetić scheduled for 14:00 on Friday, 13th of October.
On the same day at 10:00, a status conference will be held in the case of Haradinaj, Balaj and Brahimi in courtroom 3 and at 14:15 there will be an 11 bis hearing in the case of Dragan Zelenović.
As for the next week, proceedings in the above mentioned cases will continue and they will re-commence in the case of Popović et al. On 18 October at 8 am, a status conference in the case of Radoslav Brđanin will be held in the courtroom 2.
Filings:
Trial Chamber III, sitting in the case of Prlić et al, today issued a decision rejecting Croatia’s request to appear in the case as amicus curiae.
The decision states that matters Croatia wanted to raise are essentially factual while the ‘Information concerning the submission of amicus curiae briefs’ adopted by the Tribunal on 27 March 1997, specifies that ‘in general, amicus submissions shall be limited to questions of law, and in any event may not include factual evidence relating to the elements of a crime charged’. To that effect, the decision referred to earlier decisions on submissions of amicus curiae briefs in the cases of Ademi and Norac and Tihomir Blaškić. It also considered that the most of the matters contemplated by Croatia fell outside the scope of the indictment against the accused.
Furthermore, the Trial Chamber stated that it is not in the interest of justice to authorize a state, whose former political and military leaders are mentioned in the indictment as members of a joint criminal enterprise, to intervene in the procedure.
A similar request by Croatia with regards to the Gotovina et al. case is still under consideration by Trial Chamber II.

Anton Nikiforov, Advisor to the Prosecutor and acting Spokesperson of the Office of the Prosecutor (OTP), made no statement.
Questions:
Asked whether there was new information regarding the transfer of Stakić, Hodžić stated that he had no further information.
Asked if there was a request for the OTP from the EU Enlargement Commission, Nikiforov answered no that request was expected soon, whether it would be an invitation for the Prosecutor to speak to the commission or just an assessment.
