Magdalena Spalińska, Spokesperson for Registry and Chambers, made the following statement:

Good afternoon,

The Appeals Chamber today published a public version of its 30 November 2012 decision denying the Defence’s request to terminate appellate proceedings in relation to Milan Gvero, having found that he had “sufficiently recovered from his stroke to enable him to participate in appellate proceedings without infringing on his rights”. The Appeals Chamber further stated that it is “satisfied that Gvero has the ability to understand the substance of the Trial Judgement against him, understand the appeals process and its possible consequences.” Gvero’s Defence was ordered to file any notice of appeal no later than 15 days from the date of the 30 November 2012 decision.

Gvero is one of six accused in the Popović et al. case, who was sentenced to five years’ imprisonment on 10 June 2010 for crimes committed in Srebrenica. After Gvero suffered a stroke, Counsel submitted on 30 September 2010 that Gvero lacked the state of health at that time to meaningfully participate in appellate proceedings. The Appeals Chamber decided to suspend the proceedings on 13 December 2010. The Appeals Chamber’s decision is based on the careful examination of four medical reports submitted by four different specialists. The decision is available online.

Turning straight to the activities in the Tribunal’s courtrooms:

In the case of Radovan Karadžić, the Trial Chamber is currently hearing the testimony of a protected Defence witness. He is the 55th witness to be called by the Defence.

In the case of Ratko Mladić, witness Michael Rose, former UNPROFOR Commander in BiH, is currently testifying. He is the 62nd witness to be called by the Prosecution.

Proceedings in the trial of Goran Hadžić will resume on Monday, 21 January at 9:00 in Courtroom II.

In other developments, the Serbian Minister of Justice, Nikola Selaković, will be visiting the Tribunal tomorrow to meet the Tribunal’s President, Prosecutor and Registrar to discuss issues of common interest.

On Friday, the Tribunal’s Outreach Programme will be welcoming a visiting group of civil servants from Serbia, Bosnia and Herzegovina, Croatia, Kosovo, the Former Yugoslav Republic of Macedonia and Turkey. The visit is organised in cooperation with the Asser Institute as part of their Alternative Dispute programme.
